1. Terms & Conditions / Algemene Verkoopsvoorwaarden

These Terms and Conditions (“Terms”) apply to all purchases made via www.ianmcgann.com (“the Website”).
The Website is owned and operated by Atelier McGann (artist name of Ian McGann), Pimberg 79, 3360 Bierbeek, Belgium (“the Seller”).
By placing an order, the Customer accepts these Terms in full.

Products
Atelier McGann offers both physical products (such as prints or original artworks) and digital products (downloadable files).
Each product listing specifies whether it is physical or digital.

Contract Formation
An order confirmation acknowledges receipt but does not yet constitute acceptance. The contract for physical goods is concluded upon dispatch. The contract for digital products is concluded when the download link or digital file is made available.

Prices and Payment
All prices are in euros (€) and include VAT where applicable. Payments are processed securely via PayPal or Wix Payments (Apple Pay where available).

Fulfilment and Delivery
Physical products are printed and shipped on demand by Printful on behalf of Atelier McGann or by the Artist directly. Delivery within Europe typically takes 3–7 business days.
Digital products are delivered immediately after payment via a secure download link provided by Wix.

Right of Withdrawal and Returns

For physical goods: EU consumers may withdraw within 14 calendar days of delivery without reason.
For digital products: by downloading or accessing the file the Customer expressly waives the right of withdrawal as per Article 16(m) of the EU Consumer Rights Directive. If the file has not yet been downloaded, the Customer may still cancel within 14 days.

Liability and Applicable Law
The Seller is not liable for indirect or consequential losses. These Terms are governed by Belgian law; the courts of Leuven have exclusive jurisdiction.

Deze Algemene Verkoopsvoorwaarden (“Voorwaarden”) zijn van toepassing op alle aankopen via www.ianmcgann.com (“de Website”).
De Website is eigendom van Atelier McGann (artiestennaam van Ian McGann), Pimberg 79, 3360 Bierbeek, België (“de Verkoper”).
Door een bestelling te plaatsen aanvaardt de Klant deze Voorwaarden volledig.

Producten
Atelier McGann biedt zowel fysieke producten (zoals prints of originele kunstwerken) als digitale producten (downloadbare bestanden) aan. Bij elk product wordt vermeld om welk type het gaat.

Totstandkoming van de Overeenkomst
Een bevestigingsmail is slechts een ontvangstmelding en geen aanvaarding. De overeenkomst voor fysieke goederen komt tot stand bij verzending; voor digitale producten op het moment dat de downloadlink of het bestand beschikbaar wordt gesteld.

Prijzen en Betaling
Alle prijzen zijn uitgedrukt in euro (€) en inclusief btw voor zover van toepassing. Betaling gebeurt veilig via PayPal of Wix Payments (Apple Pay indien beschikbaar).

Levering
Fysieke producten worden on-demand geproduceerd door Printful namens Atelier McGann of rechtstreeks verzonden door de Artiest. De gemiddelde levertijd binnen Europa bedraagt 3 tot 7 werkdagen.
Digitale producten worden onmiddellijk na betaling geleverd via een beveiligde downloadlink van Wix.

Herroepingsrecht en Retour
– Voor fysieke goederen: de Klant kan binnen 14 dagen na ontvangst herroepen zonder reden.
– Voor digitale producten: door het downloaden of openen van het bestand doet de Klant uitdrukkelijk afstand van het herroepingsrecht conform artikel 16(m) van de Europese Richtlijn consumentenrechten. Indien nog niet gedownload, kan binnen 14 dagen worden geannuleerd.

Aansprakelijkheid en Recht
De Verkoper is niet aansprakelijk voor indirecte of gevolgschade. Deze Voorwaarden vallen onder Belgisch recht; de rechtbanken van Leuven zijn exclusief bevoegd.

2. Shipping & Returns / Verzending & Retour

English
All physical orders are fulfilled on demand by Printful or shipped directly by the Artist.
Estimated delivery within Europe is 3–7 business days; other regions may vary.
Each order is carefully packed and, where available, includes a tracking number.

Returns
To request a return, contact info@ianmcgann.com within 14 days of receipt. Items must be unused and in original condition.
Return costs are borne by the Customer unless the item is defective or incorrect.
Digital files cannot be returned once downloaded.

Alle fysieke bestellingen worden on-demand geproduceerd door Printful of rechtstreeks verzonden door de Artiest.
De geschatte levertijd binnen Europa bedraagt 3 tot 7 werkdagen; andere regio’s kunnen afwijken.
Elke bestelling wordt zorgvuldig verpakt en, indien beschikbaar, voorzien van een traceernummer.

Retourzendingen
Stuur binnen 14 dagen na ontvangst een e-mail naar info@ianmcgann.com om een retour aan te vragen. Artikelen moeten ongebruikt en in oorspronkelijke staat zijn.
De retourkosten zijn voor rekening van de Klant, behalve bij defecte of verkeerd geleverde producten.
Digitale bestanden kunnen niet worden geretourneerd nadat ze zijn gedownload.

3. Privacy Policy / Privacybeleid

Atelier McGann processes personal data in accordance with the EU General Data Protection Regulation (GDPR).
Data collected through the Website is used solely for order processing, delivery, communication, and analytics.

Third Parties
The Seller works with:

Wix (website hosting and e-commerce platform)
PayPal / Wix Payments (payment processing)
Printful (production and shipping partner)

These partners act as data processors and comply with GDPR requirements.

Your Rights
You have the right to access, correct, or delete your data, and to object to its use for marketing. Contact info@ianmcgann.com to exercise these rights.

Atelier McGann verwerkt persoonsgegevens in overeenstemming met de Europese Algemene Verordening Gegevensbescherming (GDPR).
De via de Website verzamelde gegevens worden uitsluitend gebruikt voor het verwerken van bestellingen, leveringen, communicatie en analyse.

Derde Partijen
De Verkoper werkt samen met:

Wix (hosting en e-commerceplatform)
PayPal / Wix Payments (betalingsverwerking)
Printful (productie- en verzendpartner)

Deze partners fungeren als verwerkers en voldoen aan de GDPR-vereisten.

Uw Rechten
U hebt het recht op inzage, correctie of verwijdering van uw gegevens en kunt bezwaar maken tegen het gebruik ervan voor marketing. Neem hiervoor contact op via info@ianmcgann.com.
